Well it looks like government is about to outlaw yard sales, if you sell your used items look for a lawsuit from the trademark holders.

PTCO: I have also been following this case

The US 2nd Circuit Court had their heads collectively up their backsides so far on this ruling that it will probably result in congress having to take pre-emptive action through legislation to make sure no other court is ever this STUPID. I don't see this case and Wiley & Sons' claims having much of a chance with the Supreme Court and neither do the vast majority of legal experts. It was simply an asinine ruling and you have to really question how we have anyone sitting on any court that has so little knowledge of.....anything.

The US copyright/trademark/patent laws are quite obsolete right now and between Hollywood and the other entertainment industries like music and other media trying to push these kinds of ludicrous claims, it's past time to clean it up. The recording industry, moviemakers, and now book publishers like Wiley think that you don't "buy" their products, you only "rent" them and it's highly restricted on how you "rent" their products. YOU don't own anything...they still own it.

The heart of this case is an author vs. his publishing company and should stay between them. Author used re-importation of his works to make a tidy profit and publisher cries "foul" over not being able to get their cut because they believe they "own" the work, not the author. Well, that's between the author and the publisher to hash-out, not suddenly an issue that a supposed copyright owner(in this case the publisher not the author because he obviously signed over those rights to get published)can use the now-ancient legal concept of "first sale" rights. Idiotic ruling that ignores the Constitution and established law first handed down a century ago by the Supreme Court, along with reality and commerce. Like I said, past time to clean up copyright law in the USA.

NUK_1 - Interesting

Publishers are an endangered species with the advent of direct to consumer marketing through the internet. They know it and are attempting to hold on to their relevance in a rapidly changing communications environment based on non-brokered individual to individual transactions.

It's interesting, I have a certain view of patents and trademarks that would prove as unpopular as my position on limiting the vote. Full disclosure, I do have a few patents of my own but don't really support the idea of patents. It stifles creativity and innovation in my opinion. It also benefits the few at the expense of the many because of this, it is one of those legal monopolies that the government just loves to set up to serve its special interests.

I have to part company with you on this issue with all due respect
The US Constitution Article 1 Section 8 clause 8 (think it's Clause 8)
actually requires the Government to establish this function of government.
And I for one want my inventions or written thoughts/works TO be mine, I want to reap the rewards for my work, (I'm certainly liable for it)
Heck this is one of the HUGE problems with China, they have NO respect for Patents or the "royalties" of others. They spend more time reverse engineering things than they do with innovations, eventually THIS will be the downfall of a "modern" china

Yes I struggled

with these points as well, it is interesting from a historical standpoint that the two sections of the Constitution placing government control over invention and the mail benefited Mr. Franklin.

They were after all human and served the own interests from time to time. Thus, slavery trumped ideals and the "practical" won out over injustice. This I know was all in the quest for the ideal but nevertheless it insured their wealth.

Lucky for us all that the truth prevails.

Another area that really burns me is the amount of medical and scientific research done at some public universities and elsewhere using taxpayer money that gets passed along to Big Pharma, who immediately "packages" and patents it, and has sole rights to it for several years.

Yes, I understand Big Pharma pays a lot of bucks for their own R&D but that industry has really benefited from crony capitalism and governmental favors for far too long, as well as research and breakthroughs done by others. Who was a huge proponent of Obamacare and why? Big Pharma because they know they will make Big Bucks from it.

Looking forward to yet more advertisements for "little green pills" or whatever miracle cure that everyone has to have if they would only ask their DR for it. Blah.

are dead right on this, in fact the Pharma's are pushing more and more research to public universities, I know this first hand. They have scaled back on their own internal resources, laying off thousands of employees, in favor of university driven studies. It is much easier for the politicians to funnel money to the Pharma's through universities than to give it directly to their Pharma campaign supporters. It's a win, win at the expense of the taxpayers. It is also a way for the government to control what drugs are worked on by research. Thus, it will enhance funding to special interests above the profit motive if decisions were made by private enterprise. The vast majority of funding will go toward things like autism and genetic diseases, foregoing many opportunities to treat more common diseases. As always, the allocation of resources will be shaped by politics not by need.

Most of the research that is funded by government is in the form of payoffs for supporters in the universities. From studies on "Green" energy to environmental research, these funds support a whole industry of corruption.

Just like the "bubble" in housing there is a "bubble" in higher education driven by debt financing of our children and government grants. All you need to do is look an universities and what they are offering students to join them. Everything from gourmet food to workout facilities that look like the Taj Mahal is now offered to attract government encouraged debt burdened students. I feel sorry for these kids, just like the nation, it is unlikely that they will ever be able to pay these horrendous debt loads. At the very least they begin their early careers underwater. It's all about government easy money, just like real estate. There's no good future in it.

Who would have thought the Court would decide Wal-Mart has Rights to individual property through Eminent Domain? Who would have thought the Court
would agree that the Federal Government can MAKE a citizen purchase a product or service, One thing for certain, if the court finds in favor Wiley and Sons
then go ahead and put me on the FBI's "Most Wanted" list as I WILL re-sale anything I dang well please and WILL NOT be paying a foreign entity for the transaction, I don't need my governments permission to re sale, and I'll be damned if I ask for China's permission

It will likely start with car sales and organized trading sites like EBay, Craig's list. Then cascade into local law enforcement by closing flea markets, yard sales, etc.

This will begin as soon as there is a ruling by the courts.

Won't matter who get's control of Congress...

... the President has clearly shown a penchant for disregarding the limiting powers of Congress.

He will simply issue executive orders, regulations or sign Treaties with the UN to get his agenda done.

Correct on this and if you add to this the fact that Congress has abdicated its power to the fourth branch of government. If you will, a government within a government. The Administrative bureaucracy propagates its own laws and regulations. Each department having a life of its own with the power to expand, fund through fines and police using force. It is the natural extension of democracy where the tyranny of the majority, extracts wealth from the minority using any means necessary.

If Mr. Obama wins or loses this activity will continue until the end of the country.

In short, SL I think we are too late given the current numbers and the out of control spending and the "policing" by armies of bureaucrats. Re-electing Mr. Obama will just make it come faster. Mr. Romney will not change the structure of government, it will remain a democracy.

God save us all, He is the only one that can.

You are so correct.. I believe our future is written no matter who is in control.
The dollar is going to crash. There is no way for us to pay off the debt that is being racked up and a re-set is necessary to eliminate that debt.

Businesses do it all the time but when a Country does it chaos ensues.

All we have to do is look at Spain, Greece, Ireland and many, many others to see what is to come for us.
Those holding the power believe they can weather the coming storm with their wealth intact... The elites in those other Countries thought so too.

Since they control the Government they control the power to continue to prosper... we on the other hand will find out how the wild, wild West felt well that and the great depression all rolled into one.

Fighting Tyranny - SL

It's ideas that fight tyranny and it has always been ideas. You can only carry corrupt ideas based on theft so far, then the people will catch on. We're getting there in this country, but the light hasn't come on all the way yet.

The Tea Party was the first evidence that there is an uneasiness with our government and how it is operating. This kind of spontaneous action by citizens threatens the status quo and well entrenched political power. The left rushed in to quell this "uprising" with the media's biased, then the Republicans co-opted the entire movement thanks to Sarah Palin and others.

It is not the Tea Party that is so interesting to me, it is the fact that the Tea Party actually happened at all. A popular movement based on controlling out of control government power. It is all by itself a positive indication that the people are beginning to pay attention to their freedom.

PTCO, I would love to agree and do somewhat, and I know it's a start, but to truly successful, Conservatives are going to HAVE TO realize it's not "every body else's Congress Critter it's theirs too.
