ObamaCare and the Constitution

The Framers of the Constitution created a federal government of limited, enumerated powers. In the words of James Madison, “The powers delegated by the proposed Constitution to the federal government, are few and defined. Those which are to remain in the State governments are numerous and indefinite.”

Throughout the country, federal courts are presently considering whether this original design has any remaining viability. The question before these courts asks: Is Obamacare constitutional?

Regulation of economic transactions, of course, is unremarkable, and Article I of the Constitution gives Congress the power “to regulate Commerce ... among the several States.”

Obamacare, however, goes far beyond garden-variety regulation. The law’s centerpiece, the much-maligned individual mandate, compels every American – at the risk of criminal penalties – to purchase health insurance from an insurance company. And therein lies the rub.

It is one thing to regulate all those who choose to engage in an economic activity; it is another thing entirely to force an individual to engage in a particular economic activity in the first place against that person’s will.

Such a shift dramatically alters the nature of congressional power under Article I. The power to regulate something already in existence becomes the power to compel something into existence.

Even the laws we typically conceptualize as mandatory are different than the individual mandate in critical respects. Yes, everyone must pay taxes, but only if they choose to earn an income. Yes, everyone must buy auto insurance, but only if they choose to drive. Yes, criminal law details a whole host of things we cannot do, but it does not say that there are things we have to do.

Obamacare, on the other hand, directs this: Simply by being alive, each of us must do business with an insurance company. This total deprivation of choice is unprecedented in American law and constitutes a form of coercion that poses a significant threat to individual liberty.

Allowing the federal government to exercise this type of unconstrained power removes any pretense that the Constitution limits the reach of Congress in any real way. Words have meaning, and danger looms for all Americans when politicians and judges cast aside the plain meaning of words for short-term, partisan ends.

If the text of the Constitution can blithely be ignored in this way, then it follows that placing faith in that document to safeguard our civil liberties is a grave miscalculation. Our rights devolve to only those that the Supreme Court allows us to have. When this happens, the rule of law gives way to the shifting rule of five-justice majorities on the Court.

And that brings us back to Obamacare. The highly politicized manner that accompanied its passage likely dooms any effort to reach consensus on its constitutionality as the merits of the law have long ceased to matter.

Still, there is hope. Despite the many differences between liberals and conservatives, the two sides do share a distrust of government overreach that sometimes – albeit all too infrequently – overlaps. Perhaps the vast tentacles of Obamacare can awaken this common fear to produce an unexpected unity.

The chief discomforts with the new healthcare law need not – and indeed, will not – be the same. For the conservative, allowing Obamacare to stand would remove any constitutional constraint on centralized regulation as well as obliterating any pretense of state autonomy.

For the liberal, permitting government the power to mandate that every person enter into a contractual relationship with insurance companies gives enormous power to big business at the expense of individuals, especially those presently without insurance on the lower end of the economic ladder.

While the sources of uneasiness in these respective critiques differ and reflect the competing ideological concerns in the liberal and conservative worldviews, both analyses reach the same conclusion: this law goes too far.

The Constitution ultimately protects all of us from the strong hand of government. While we may disagree over the exact contours of these constitutional safeguards, Americans of all political stripes agree that (a) there should be meaningful limits on government and (b) the Constitution should supply these limits.

The individual mandate, however, mocks both of these baseline premises. A federal government that can force its citizens to engage in particular activities is a government unrestrained by the words of the Constitution. Power and politics – not the rule of law – become the order of the day.

Obama's Illigal Uncle is on the road again

I hear rumors of a reality show in the works starring him and Auntie Zeituni called "Lifestyles of the Illegal Deadbeat Relatives of Presidents Who Eat Dogs".

The only problem the producers are having (no, funding isn't an issue-Barack's Hollywood buds are ponying up the dough) is that they have to obscure the faces of the stars of each episode to keep them from being deported before each show airs. Seems there are more in the wings, and now that the first two have screwed our systems of laws and justice, it's open season on coming out if you can say "Hussein is my 'bro, man".

Those Illegal Obama's

I see that dear old auntie Zeituni has authored a book titled "Tears of Abuse". She describes a journey to the United States “where she faces the unthinkable; failing health and quarantined in a hospital while on vacation in a foreign country.”

Vacation? Surely she meant to say “welfare.”

“As her story unfolds she becomes a resident of (a) homeless shelter and a subject of deportation.”

How dare they! Just because she’s an illegal alien, they want to deport her.

Of course remember that she was quoted on a Boston TV interview that she's done nothing wrong by illegally living in the United States for years and is therefore deserving of amnesty.

"If I come as an immigrant, you have the obligation to make me a citizen"....

Anyways, uncle "Stinky "( a name given to him by those that patronize Conti Liquor where he is employed ) will fight deportation. His legal team will try to sway the immigration judge that his life would be in danger because of tribal strife if he went back to Kenya. Dear old auntie pleaded the same.

Strife if he went back to Kenya

Nope, this case will be before a paid off judge before the November election and Stinky thinks he will have 4 more years of driving drunk around the streets of Boston.

However, when the dog-eating Barry gets the benefit of the voting "change" we all know will actually happen, Stinky will be looking in the rear view mirror every time he turns the key to slosh his merry way home. If you is a cop in Boston, you have a loooong memory. Stinky will be wishing he had a tribe to be in strife with then.

Oh, and poor old unhealthy, sickly Auntie Zietuni? Funny how a book deal that allows you to travel to sign your book of lies for a small fee sure makes those aches and pains go away in a flash. Ain't no better tribal medicine than that, now is there?

I spent some time around New York City last week. Just imagine, they have street named "Utopia Avenue". (eyes rolling). Off to Denver tomorrow to see the youngest graduate from expensive "U". Next week it's up to Winnipeg and after that it's time to play with those pesky fish in Destin.

About those feds....... I think they're overwhelmed and not to mention that Eric "The Gun Runner" Holder is looking the other way.

Roundabout Alaska

I'm going to try this one more time, and then I'm leaving it alone. The Permanent Fund was started with a set amount of money that was then invested. Those investments did very well, and in the early 80's the state decided to share A PERCENTAGE of the PROFIT from those investments with the legal residents of the state. The Fund itself is never touched. In any given year, that set percentage can allow for higher or lower payouts depending on how much profit the Fund makes. Again, Sarah Palin has nothing to do with determining the amount of the payout. It follows that as the Fund makes more money, the payouts will grow. I am not here to debate Sarah Palin's politics, which you obviously don't like. I am just here to offer facts about the Permanent Fund Dividend and how it works. As for whaling, it is an important part of the economy for the nine villages that whale in Alaska. Again, I offer this site in explanation http://www.highnorth.no/library/hunts/other/al-es-wh.htm . As you can see, there is a lot more to a whale than blubber. I am not a native Alaskan. I was up there for 4 years with the military. It is a magnificent state and I get riled when it is misrepresented as some frozen, backward stereotype. I suggest you put it on your bucket list. I think you'll be pleasantly surprised.

I am also for "spreading the wealth."

I want the oil companies to NOT CONTINUE getting huge tax breaks by writing off capital expenses in one year! Thereby paying no taxes on that part.

They simply run out and drill empty holes amounting to as many as is needed to not pay the taxes. They even find oil once in awhile!

The "OLD SEVEN SISTERS' oil companies have been running our finances since the beginning of the 20th century. Caused most if not all of the middle-eastern wars also.

All the Bushes, Reagans, Cheneys, etc., have known this since they were children! (Except Reagan, who was never a child).

Based on the 2006 TOTAL population of each respective race in the United States, it
seems to be equally distributed among citizens:
From 2006:

Also, apparently there are about 80,000,000 total households.

You say 11,661,000 whites draw welfare
You say 11,362,000 blacks draw welfare
You say 5,083,000 hispanics draw welfare

Percentage of whites in population = 68%
Percentage of blacks in population = 17%
Percentage of Hisp. in population = 15%

Number of whites = .68 X 308,000,000 = 209,000,000
Number of blacks = .17 X 308,000,000 = 52,360,000
Number of Hisp. = .15 X 308,000,000 = 46,200,000

so: 11,661,000 divided by 209,000,000 = 6% whites on welfare
11,362,000 divided by 52,360,000 = 22% blacks on welfare
5,083,000 divided by 46,200,000 = 11% hisp. on welfare

It was also just announced that 43% of the population was on food stamps!
I would guess those same percentages would apply for number on stamps.

Yes, as many whites as blacks draw welfare, but the percentage of whites in the population is four times as great!

These numbers don't indicate any particular reason for this and it is all of our fault for allowing it to occur!

Just wanted to see if you had time to understand the correct way to read problems!

While I am at it, do you think the APS situation will be quickly resolved so that only students who legally pass exams and daily papers can then be promoted?

Will all teachers be checked for qualifications to teach? Where did BS< BA< and Masters degrees come from? What is the IQ and Wunderlick scores for teachers? Students?

They must be helped and catering more to their ignorance will not help them ever.

They again have hired a super who will obviously float along with the old system and act very, very, slowly. Same in Dekalb.

I know that you are going to say something like:
We are all human beings, all, and must have whatever advantages we deserve for being as we are!
Don't know what that means to you, but I know what it means to me.

America has citizens who are ignorant and corrupt. They come in all colors and sizes. Now that's the truth! The latest numbers tell as the whites are faring better than minorities in this country. (Did we need the numbers to make this point?) When one needs to quantify in order to feel suprerior, that's when ones own credibility/security comes into question. You come across as a pretty secure guy - others? ? ? It makes little sense to use numbers to describe the human condition - if you're sincerely looking for ways to improve the condition. Numbers assist in measuring progress - or building an insecure ego.. . IMHO

Have you heard a few thousand of them lately in the APS mess? Has nothing to do with feeling superior! Just being honest and trying to solve the problem rather than go on, going on!

They can't be solved as long as there are students who need to be failed and given special help with no cheating.
As long as we have teachers and administrators who allow massive cheating and do it themselves, there iS no ANSWER.

AND , AS LONG AS WE IGNORE AND COVER UP SUCH A HIGH PERCENTAGE OF WELFARE AND FOOD STAMP USEAGE it will not get better.

I certainly agree with your point and brought out the numbers only to show that the problem is human - and not necessarily racial. Frustrated people all over the globe are involved in exhibiting behavior that is considered unacceptable. About those kids who have been 'cheated, there are community groups mobilizing now to provide 'mentoring ' and tutorial help. Many are listening to Mr. Cosby. Much 'good' that goes on in the minority community is not considered 'newsworthy'. . . but this scandal hurts minority children - and appears to be self-inflicted. There are many in the 'majority community' who are also stepping up to the plate. You see, there are some in the Atlanta community who see American children as the victims.

...at how Obama spoke highly of her in his book (I've been told such; I wouldn't have wasted my money on it - either way, not the point) but yet w/ his income (and his corporate lawyer wife's) he couldn't help her out. Quite a reflection of the man; financially able but unwilling to help out his aunt (unless it's to pull strings to keep the illegal alien [at the time] in our country). Dump her on the dole; that's family for you...what an inspiration.

FRAMINGHAM, Mass. (AP) — President Barack Obama's uncle was stopped on suspicion of drunken driving, told police he planned to arrange bail through the White House and was being held without bail on an immigration detainer, authorities said Monday.

Onyango Obama was arrested last week in Framingham, about 20 miles west of Boston, after police said he made a rolling stop through a stop sign and nearly caused a cruiser to strike his sport utility vehicle.

Police said that after being booked at the police station, Obama was asked whether he wanted to make a telephone call to arrange for bail.

"I think I will call the White House," he stated, according to a police report filed in Framingham District Court.

Police said Obama, who's originally from Kenya and is the half-brother of the president's late father, pleaded not guilty Friday and was being held without bail on a detainer from U.S. Immigration and Customs Enforcement. In a court document, ICE said he had an earlier deportation or removal order.

His immigration status couldn't immediately be confirmed, but such orders are generally reserved for people living in the country illegally.

Michael Rogers, a spokesman for Cleveland immigration attorney Margaret Wong, said Wong will represent Obama. He confirmed that Obama is the half-brother of the president's father and the brother of another relative, the president's aunt Zeituni Onyango, of Boston.

In "Dreams from My Father," the president mentions photographs of his Uncle Omar, "the uncle who had left for America twenty-five years ago and had never come back." He also discusses a Kenyan expression about getting lost, meaning to not see someone in a while or to move away and stop communicating with relatives — "like our Uncle Omar, in Boston."

You sure you don't want to talk about Perry calling SS a ponzi scheme ala Berny Madoff, income taxes "unconstitutional," or Bachmann cracking jokes about the hurricane which has cost a billion dollars and killed over 30 people? Those are actually DIRECTLY from the candidates, and those are the kinds of things which "could be a problem." What say you?

Well, he's admitted to the facts of his drunk driving incident. His license is suspended for 45 days, has to pay a fine and court cost and, is on probation for one year.

What's interesting is that during the trail this illegal alien demanded to see the arresting police officer's driving record in court.

Now this brings new meaning to the audacity of hope.

Oh, he goes before an immigration judge in May.

A further note on this. The drivers license was fraudulently obtained in the first place, now it has been taken away. How in the world do apply to get it back if you are still illegal? Is the DMV going to just hand it back to him when he applies for a "hardship waiver"?

Today we learn he cut a guy's hair as a prank when he was in high school. This is gay bashing because the hair was blond. Romney was 15. Oh yeah, it was completely coincidental that this was released 1 day after Obama came out (so to speak) for gay marriage. Good coverage by the main stream media. Does anybody believe this crap? Or the timing?

Howie Carr is the best but how can he live happily in Boston?

I thought he was joking about her new book in today's column, but sure enough it is a real book with a real book tour and a pretty good website. Which leads to a question - If criminals can't profit from their crimes by writing books, why is an illegal alien on welfare allowed to do so? And will she stay on welfare when the book proceeds roll in? Will she still expect her free housing when her income increases beyond whatever amount she put on her free housing application? I know it is Massachusetts, but even there someone should have some sense and make some adjustments to her subsidized lifestyle.

This would be a perfect issue for Scott Brown to take on to be sure he gets reelected. He's already pulled ahead of the 'lil injun, who shot herself in the foot (which is hard to do with a bow and arrow) and taking on Aunt Zetuni would make him one of the few Republicans with guts. Go for it Scott. You can even embarrass Prezbo at the same time. Of course if the Dems keep control of the Senate, you will be Mr. Irrelevant, but it is worth a shot. Republican takeover - you'll be a big deal.

Cyclist. The law suits with respect to brand new immigration laws, have to do with the constitutionality of those laws. Conservatives might be okay with "big government" legislation that potentially violates freedoms of legal citizens who happen to be of Hispanic descent, but many, including myself, are not.

One only has to remember Jan Brewer's answer to "What does an illegal alien look like?"

As conservatives* use to believe, govt should have limited powers to search, seize, and detain legal citizens without probable cause. You may think that these broad-reaching laws are okay as long as they get some illegals; that some innocents being harrassed is just the price of doing business GOP style, but I disagree; and the courts will decide. I like the idea that new legislation has to be vetted in court to insure it does not infringe on our Constitutional rights as LEGAL citizens.

Anywho, welcome to the era of big government conservatives. Up next we'll regulate the uterus and gays ;-)

ps: We are deporting people by the plane load. I've been a part of this very recently. Contrary to the GOP narrative, our govt who's budget is being whittled away by GOP legislators is still trying to enforce deportation; which costs money ya know.

He'll most likely will be able to stay because of some tribal in-fighting in Kenya much like the same reason is darling sister is staying.

In the mean time, those of us that are law abiding citizens are left wondering if we are just a bunch of chumps and those illegal's out there are now wondering if their president is going to help them.

Perry is very "Obama like" in his approach to using government to fulfill his "mission" or "vision". Look at what he did in Texas, remember the forced use of vaccines on children by the Texas legislature? Perry was for it before he was against it, then he was for it again. He of course used the "right" of the state to use force to protect unborn life, even if the life wasn't conceived quite yet.

If Perry is selected, then we will have two big government guys running. Nothing will change and the government will just get bigger.

BTW, Why would you be involved in the deportation of illegals? Are you a government worker?

"Elections have consequences. We won" That seemingly doesn't apply when his own party gets demolished in the fall of 2010 and has to deal with a bunch of newly-elected Repubs who seemingly intend to vote the same way they campaigned. Despite the media and talking heads' hysteria, most of those elected in 2010 aren't connected with those terrorist, hostage-taking Tea Party member either.

Obama makes me long for the days of Slick Willie. At least Clinton had some competence and wasn't in 10 levels above his pay grade. Oh wait...that's probably because he had some real experience and credentials before getting elected instead of a whole lot of nothing.

That means the Palin family got several checks each month!

It has been about $2000 for everyone, plus a $1200 one from Palin for gas money.

Along with blubber and salmon and the checks one can live in Alaska without working.

Heck that is pure socialism, along with buying her election with the bribe.

The Fund was started in 1976 from revenues from the pipeline and recently posted a balance of $40.1 billion dollars. In the early 80's the Fund started paying out a percentage of the profits earned by investing the money in the Fund in the form of an annual (not monthly) dividend to all qualified residents of the state. The amount of the dividend payout varies from year to year and was originally designed to boost the economy of the state, which it continues to do. In the years I lived there, the amount ranged anywhere from $300 to close to $1000 - hardly a living wage. So we all continued to work in our regular jobs just like everyone else. That is when we weren't whaling for blubber (I won't even address the idiocy of that remark).We used ours to buy Christmas presents usually. And Sarah Palin was a school girl in 1976 - hardly old enough to have had anything to do with the establishment of the fund. ...to your address to me; not anything to do w/ the blog. For one, yes, they were actions Clinton failed to address, other than lobbed some cruise missiles at a couple terrorist training camps. A-stan was a popular choice, even Obama - in his short 2 yrs as a senator - voted for it. The problem w/ Iraq was no viable exit strategy; Bush did bone this, assuming the people would all work together to form a new Iraq. Hussein did say if he ever was deposed, his successor would have to rule 7 Iraqs (the man knew his country!). Oh, and he also said he would have continued in his quest to obtain nuclear and other WMDs (stated to his 'handler' while awaiting execution - as seen on 60 Minutes).

She is an illustration of the problem. She and millions of others - we will probably never know the actual number - of illegals are using services and resources that were never intended for them.
