PTC headed to lawsuit over mayor’s pay cut

City’s risk management group won’t cover cost of council majority’s defense, potentially leaving taxpayers on the hook

It appears that Peachtree City taxpayers are on their way to paying thousands of dollars for a legal battle between Mayor Don Haddix and his fellow city council members.

The continuance of a steep cut to Haddix’s pay was adopted as part of the city’s upcoming budget Thursday night, despite a letter to the city last week threatening a lawsuit if the mayor’s pay isn’t fully restored.

The potential liability to taxpayers has been increased because the city’s risk management company will not cover the defense of council in such a lawsuit. That means the city council will not be able to cap its costs for the legal action at $25,000, which is the city’s deductible.

The letter from attorney Michael Bowers gave council 30 days to restore Haddix’s pay and compensate him for missed back pay. Haddix’s pay was cut in May from $750 a month to just under $75 to recoup money the city spent to indirectly reimburse Haddix for his legal defense in a libel lawsuit filed by former Mayor Harold Logsdon over an email Haddix sent to a city employee.

If Haddix initiates a suit seeking reinstatement of his pay and lost wages, the city may perhaps also be on the hook for his legal fees, along with any damages approved by the court, should he prevail.

In the notice letter to the city, Bowers notes that the city charter requires the salary of mayor and council to be set during the previous term of mayor and council. Council’s solution to get around that language was to pass the pay cut as a “budget adjustment.”

None of the four city council members would answer The Citizen’s questions after the meeting about whether taxpayers could be expected to foot the bill for council’s defense if a lawsuit were to be filed by Haddix.

The Citizen also inquired if the council members would be willing to pay for the lawsuit out of their own salary, in the same way they have forced Haddix to pay the city back for its expense defending him in the libel lawsuit. Again, there was little reply from council members as they walked out of the room, save for a comment from Councilman George Dienhart, who said “That’s a good question!”

instead of taking over 10K from the City coffers and using it for their own benefit.

Frankly, I see nothing wrong with my City being reimbursed for Haddix's actions.

Classy folk don't slander people, they just get part-drunk

We have to remember how this whole mess started with our temporary mayor writing an e-mail to Joey Grisham stating the former mayor came to meetings part-drunk. Needless to say, none of our previous mayors have ever done or said anything nearly as stupid as that. Immature behavior from a person entirely without class. Remember the first attempted defense? Logsdon was a public figure, therefore he can be slandered without penalty. Why was he a public figure all of a sudden now after he dropped out of public office or even running for public office? Well, because he had lunch with his former campaign manager.

Even if that gem of a defense comes from some small-minded lawyer grasping at straws, it speaks volumes about the mind set of an unbalanced and clueless defendant in a situation that is well beyond his capability to understand. I think even the 3 tries at GIRMA for funding show that in his own mind he was not wrong to slander the former mayor.

There is truly a mental illness component to this situation, IMHO. Maybe there is a case to be made that he is unfit to perform his duties and a trustee or guardian should be appointed. Any volunteers? Kimmy, how about you?

A good first step could be a family intervention. Pumpkin, you up for a little confrontation? It is for his own good, doncha know? Maybe we can get some court-ordered counseling, of course the city would gladly pay for it.

I don't see anything wrong with the city getting its $10k back either. Of course I do see how some judge or even a jury could see things differently - especially one that hasn't been exposed for a full 3 years to this man's unbalanced behavior.

evaluate you. You dare to bascically call our Mayor mentally ill. GIRMA ruled, it should have been finished, done and dont vote for him next time. You and other fine citizens think you are know it alls, keep egging it on and tell GIRMA they are wrong. So filled with hatred with no compassion or respect (council meeting was horrible), more a know it all bully, until another fine know it all citizen files suit and you duck and roll. More bla bla bla until the Mayor stands up again and you are told by yet another authority bring it on. No the city should not pay for it, you hand full of know it alls should meet at your house, invite Logsdon (no---wait---- you bitched about him so much he probably hates your guts) pass the plate around and pursue your scholarly knowledge, hey even co-counsel. You have crucified our Mayor and citizens enough. Robert, S--- or get off the P--! I say it again I dont agree with everything the Mayor has done, but I am certainly respectful for the man putting himself out there, dont vote for him next time. Big step from "there is a mental illness component to this, INMO" to your 4 diatribes - which are remarkably similar. We have already diagnosed the mayor's meglomania a long time ago, but the diversion of city funds, his total disregard of taxpayer's money and his abusive and offensive way of fighting back against the others on council (about almost everything) suggest something more serious than just meglomania. I believe it would be best for all involved if he could see someone and seek out the root cause of his problem and maybe get some treatment. At the same time, pumpkin, you could use a little anger management therapy.

When is the last time you made an appointment, you Robert, or you and your posse, to meet with the Mayor. Speak with him professionally and put it in writing instead of hanging him here. Or are you just good behind the screen and your personal space. When have you shown your face at City Hall, there are several conference rooms private enough without meeting in the Mayors office where someone might actually see you. Well, that was pleasant. Very insightful of pumpkin.

Good of her to share her views. I always like to hear both sides of an issue because sometimes the opposing side can make good cognitive points and allow me to ponder an aspect of the issue that I had previously not considered. When that happens, it may or may not change my opinion, but I do feel enlightened and empowered with the new information I have gleaned.

Of course none of that happened this time, but I want everyone to know it is possible.

I am, of course, relieved that our mayor does have 1 supporter here, because he will need both a campaign manager and speech writer to smooth out his rough edges for his reelection campaign - coming up in just 10 or 11 months.

When did you come up with that question? If you voted "for him" did you even know how he got on the ballot? What........ you figure at least a background check, right? Or what, was it only a recommendation? Did you attend a rally, approach his supporters, campaign, ever speak with him before you voted, or just say hey Joe likes him, so I do? Granted "voters turn out was low" but guess what, so are the number of citizens that are willing to put themselves out there to run for office. Our Mayor has lived in PTC twenty plus years and he has seen them come and go. He had a understanding and drive of what this city set out for and how turned around it became, because of money and, yes gitreal, "Virginia" politics. PTC has well educated citizens, with high paying incomes, living in a restricted fairytale city, with golf courses, country clubs, one decent hotel,liquor stores,grocery stores for all (god forbid the little lady, maid or kids couldn't take the golf cart). Guess what, if you work anywhere other than your National, International business they dont want you living here, not in PTC, no waitress, warehouse, clerks, labor, you are hourly we cant have low cost housing in our city. Go to coweta, fayetteville better yet futher south or north, east or west. But strip malls (so many, and empty)good schools?, hey a Kmart, Wmart, big box stores and business big and small leaving. Next time if you vote ask the questions first or really if you dont have time to get involved better to not vote than take your neighbors word for it. ?

The question is why didnt or dont you know the answer?

If you voted if you took time to get to know Mr.(Mayor) Haddix before you voted you would know where he worked what his experience was who he is. My "ranting" is did / do you even take time.

Whether any of you gossips believe it or not I am not Mrs Haddix but I certainly met both before I voted, I know his background and yes he has made decisions Ihave not agreed with.

When will this end?

When one finds themselves trapped in a hole, the first priority should be to stop digging. We all realize that Don Haddix is likely the most reprehensible mayor in the state, and likely the most antagonistic. What we as citizens wish to see is a Council that can somehow exist for another sixteen months without the embarrassing crap emanating from city hall.

Can the five elected members not realize the fiasco they have collectively caused? Can the lawsuit be really worth the continued embarrassment for our town? I think not.

Gathering information on Peachtree City Council

In gather facts, regarding what's happening in Fayette, I am beginning to check information now from both newspapers and more specific based upon the event.

There are websites and blogspots on Fayette County schools and even some of our council members have blogspots.

Clayton County?

Did the State move Clayton County's borders south to encompass Peachtree City and neglect to tell the residents? This whole situation is like a scenario right out of the Clayton County handbook. The next thing you know we will have snipers on the roof of City Hall and people being escorted out of the building. It is simply a petty power struggle with no chance of a winner at any level.

Perhaps common sense will win out but I seriously doubt it. How long will it be before this nonsense starts to have an effect on the "desirability" of Peachtree City.

and was the instigator of all of this. It was a stupid thing to do to begin with and evidently they did not have the legal right they professed to have. I would not be surprised if they did not have other lawsuits brought against them by PTC residents if they continue with this foolishness and the city is hit with the expense. Our finances are in the sewer as it is. It is time for everybody to act as grown-ups and take care of city business.

How shameful these adult citizens are. I cannot believe the disrespect and arrogance they've shown to the city, their positions, but mostly direct to you. Who do they think they are; seems this law suit is the only thing to finally shut them up. Can't wait for the next chapter, they know they are wrong Mayor, but like little boy bullies they grow up to full grown bullies. I would love to know how many citizens would support any one of the current council should they run for Mayor, oops sorry they are just blow hard know it alls, not one of them would dare to run. No, no one on council is ever going to be able to get elected mayor - even though any would be an improvement over your hubby. My neighbor's retarded tail-chewing dog who only speaks when spoken to would be an improvement over Haddix. The council really dropped the ball on this salary thing - poor research and bad legal advice. I used to think Kimmy was showing some leadership, but now she's just one of the snarling pack trying to divert attention away from their own bad decision-making.
Mike King or Cyndi Plunkett will be our next mayor. Can't be soon enough for me. I would also support Terry G. and MadMike. OK, I'll support Kimmy if she grows a spine. Nice. I would do the same for Romney if he grew a spine and attacked the Bamster head on.
